A Supremely Sweet Victory for Clean Air and Public Health
“The Supreme Court’s decision, which addressed strengthened air quality standards for PM and ozone, represents a major victor for public health and for the rule of law,” writes Howard Fox, managing attorney of Earthjustice in Washington, DC in the June 2001 issue of EM magazine.
“The court did not rule on the scientific basis for the new standards, because the issue was not before the court; however, the decision does remove important legal hurdles that industry had thrown into the path of the new standards, and therefore, it is a major step forward in the battle against air pollution,” the article continues.
Fox represented the American Lung Association® in the case,
Whitman vs. American Trucking Association, Inc. .
